Information Notice about the processing of personal data, as per Art. 13 of EU Regulation 2016/679 – GDPR.

Information Notice regarding the processing of personal data collected from the data subject. In compliance with the provisions of Articles 13 and 14 of the GDPR - EU Reg. 2016/679 (General Data Protection Regulation) we hereby inform you about the processing of the data you have supplied. This information notice is not to be considered applicable to any other websites that can be visited via links present on the websites of the Data Controller’s domain, who is not to be held liable in any way for third party websites. This information notice is provided in compliance with the provisions of Art. 13 of EU Reg. 2016/679 (General Data Protection Regulation) and is based on the provisions of Directive No. 2002/58/EC, as amended by Directive No. 2009/136/EC, concerning Cookies and on the contents of the Data Protection Authority’s provision dated 8 May 2014, also concerning cookies.

1. DATA SUBJECTS

The DATA CONTROLLER, pursuant to Articles 4 and 24 of EU Reg. 2016/679 is HAROBAU SRL with headquarters in Via Nazionale, 15 - 39044 Laghetti di Egna (Bolzano, Italy).

 

2. PURPOSES AND LAWFULNESS OF DATA PROCESSING

The personal data supplied shall be processed in compliance with the conditions of lawfulness as per Art. 6 of EU Reg. 2016/679 for the following purposes: a) management of pertinent data processing (art. 6, (b)): – navigation on this website; – compilation of any data collection form for sending a request for information to the Data Controller; – compliance with contractual, legal or administrative/accounting obligations; - market surveys and any other promotional and advertising actions. For the purpose of applying the provisions regarding personal data protection, processing performed for administrative/accounting purposes is connected to the performance of organizational, administrative, financial and accounting activities, irrespective of the nature of the data processed. In particular, these purposes are pertinent to in-house organization activities, to activities that are functional to contractual and pre-contractual obligations, and to information activities.

3. DATA RECIPIENTS OR CATEGORIES OF DATA RECIPIENTS

The personal data collected may be transferred to recipients, as indicated in Art. 28 of EU Reg. 2016/679, who will process the data in their capacity as Data Processors and/or individuals acting under the authority of the Data Controller and of the Data Processor, for the purpose of complying with contractual obligations or related purposes. More precisely, the data may be communicated to recipients belonging to the following categories: – Subjects supplying services for the management of the information system and of the communication networks of HAROBAU SRL (e-mail system included); – Firms or Companies working under assistance and consulting contracts; – Competent Authorities for compliance with legal obligations and/or provisions by public bodies, on request; – In the event of administrative-accounting purposes, the data may also be communicated to commercial information companies for assessment of the solvency and payment habits and/or to subjects in charge of debt collection. The subjects belonging to the above mentioned categories shall operate as Data Processors, or autonomously as distinct Data Controllers. The list of designated Data Processors is kept constantly updated and is available at the headquarters of HAROBAU SRL.

4. TRANSFER OF DATA TO THIRD COUNTRIES AND/OR INTERNATIONAL ORGANIZATIONS

The personal data supplied shall not be transferred to third countries that are or are not members of the European Union.

5. STORAGE PERIOD OR METHODS

Data processing shall be carried out via automated and/or manual means, using methods and instruments designed to guarantee maximum security and confidentiality, by subjects specifically assigned to this task. In compliance with Art. 5, § 1, (e) of EU Reg. 2016/679, the personal data collected shall be stored in a format that allows identification of the data subject for a period not exceeding that required to achieve the purposes for which they were collected. 6. NATURE OF DATA SUPPLY AND REFUSAL TO SUPPLY

Apart from the information supplied regarding navigation data, the user is free to provide personal data in dedicated areas of the website. The supply of personal data for the purposes indicated in item a) of this document is necessary for completing the specific functions and for obtaining the services offered by the Data Controller, such as, for example, receiving a reply to the request for further information. If the personal data is not supplied, the data subject may fail to receive the service requested or may not be able to use the services offered by the website.

7. RIGHTS OF THE DATA SUBJECT

You may exercise your rights as expressed in articles 15, 16, 17, 18, 19, 20, 21, 22 of UE Reg. No. 2016/679, by contacting the Data Controller via e-mail at info@harobau.it. You have the right, at any time, to ask the Data Controller to access your personal data, to rectify them, erase them and restrict their processing. You also have the right to object to the processing of your personal data at any time (including automated processing, such as profiling, for example), and the right of data portability. Without prejudice to any other administrative and jurisdictional claim, if you believe that the processing of your personal data breaches any provisions of EU Reg. 2016/679 you have the right, pursuant to Art. 15, (f) of the above mentioned EU Reg. 2016/679, to lodge a complaint with a Data Protection Authority and, with reference to Art. 6 §1, (a) and Art. 9, §2, (a), you have the right to withdraw your consent at any time. In the event of a data portability request, the Data Controller will send you your personal data in a structured, commonly used and machine-readable format via automatic device, without prejudice to §§ 3 and 4 of Art. 20 of EU Reg. 2016/679.
